1. Agreement to Terms
By accessing or using the Toddler Tracker mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you do not have permission to access the App.
2. Description of Service
Toddler Tracker is a mobile application designed to help parents and caregivers track various aspects of a toddler's daily activities, including mood, food intake, sleep patterns, and media consumption. The App may include AI-powered insights and recommendations based on the data provided.
3. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password. You agree not to disclose your password to any third party.
4. User Content
Our App allows you to enter, upload, and store content related to your child's activities. You retain all rights to your data, but you grant us a license to use this information to provide and improve our services.
You are solely responsible for the data you enter and must ensure it does not violate any laws or infringe on any third-party rights.
5. AI Features and Limitations
The App includes AI-powered features that analyze data to provide insights and recommendations. You acknowledge that:
- AI analysis may contain inaccuracies or errors
- AI recommendations are not a substitute for professional medical or childcare advice
- All insights should be verified and not relied upon as the sole basis for decisions regarding your child's care
- You should exercise your own judgment when interpreting AI-generated content
6. Intellectual Property
The App and its original content, features, and functionality are owned by Toddler Tracker and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
7. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.
Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App or contact us to request account deletion.
8. Limitation of Liability
In no event shall Toddler Tracker, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the App
- Any conduct or content of any third party on the App
- Any content obtained from the App
- Unauthorized access, use or alteration of your transmissions or content
- Reliance on AI-generated insights or recommendations
9. Disclaimer
Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied.
Toddler Tracker does not warrant that the App will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. The results that may be obtained from the use of the App are not guaranteed to be accurate or reliable.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
